1. Acceptance
By accessing or using the NexusPool website and the NexusPool mining communication protocol (together, "NexusPool"), you agree to these Terms of Use ("Terms"). If you do not agree, do not access or use NexusPool.
2. What NexusPool is (and is not)
NexusPool is free, non-custodial software — a Bitcoin mining communication protocol (Stratum V1/V2) made available by SweetHash ("SweetHash", "we", "us"). NexusPool is not a product, service, brokerage, exchange, wallet, investment, or offer, and using it creates no commercial, consumer, fiduciary, agency, or custodial relationship between you and SweetHash. SweetHash never takes custody or control of your funds, private keys, or hashpower. Any block reward is paid on-chain by the Bitcoin network protocol directly to the Bitcoin address you supply; SweetHash does not hold, route, or distribute rewards and charges no fee.
3. Eligibility
You must be at least 18 years old and legally able to form a binding agreement. You may not use NexusPool if you are located in, ordinarily resident in, or a national of any jurisdiction subject to comprehensive U.S. sanctions, or if you are on any U.S. government restricted-party list (e.g., OFAC SDN). You are responsible for determining whether your use is lawful in your jurisdiction.
4. No guarantee of results; the nature of solo/lottery mining
Bitcoin block discovery is probabilistic. The chance of any participant finding a block in a given attempt is approximately p = your hashrate ÷ (network difficulty × 2³²) — a lottery. SweetHash makes no representation, warranty, or guarantee that you will find any block or receive any reward, ever. Displayed statistics (hashrate, best-share difficulty, estimates) are informational and do not predict future results.
5. Assumption of risk
You knowingly assume all risks of using NexusPool and of Bitcoin mining generally, including without limitation: mining variance and the possibility of never finding a block; cryptocurrency price volatility; electricity, hardware, rented-hashpower, and opportunity costs; software bugs, downtime, forks, reorganizations, or changes to the Bitcoin protocol or network difficulty; loss of access to your wallet or private keys; and changes in law or regulation. You may lose money.
6. No professional advice
Nothing on NexusPool is financial, investment, tax, accounting, or legal advice. SweetHash is not a licensed advisor. Consult your own qualified professionals before making decisions.
7. Your responsibilities
You are solely responsible for: supplying a correct Bitcoin address you control; the security of your own wallet, keys, hardware, and any rented hashpower; and your own compliance with all applicable laws, including tax reporting on any rewards.
8. "AS IS"; no warranties
NexusPool is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty of availability, accuracy, uptime, or that operation will be uninterrupted or error-free. Some jurisdictions do not allow certain warranty exclusions; some of the above may not apply to you.
9. Limitation of liability
To the maximum extent permitted by law, SweetHash will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, bitcoin, data, or goodwill, arising out of or relating to NexusPool, whether in contract, tort, or otherwise, even if advised of the possibility. To the maximum extent permitted by law, SweetHash’s total aggregate liability for all claims relating to NexusPool will not exceed US $100. Some jurisdictions do not allow certain limitations; some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless SweetHash from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of NexusPool or your violation of these Terms or of any law or third-party right.
11. Acceptable use
You may not use NexusPool to: violate any law or sanctions; infringe others’ rights; introduce malware; attempt to disrupt, overload, or gain unauthorized access to the infrastructure or other users; or misrepresent your identity or hashpower source.
12. Intellectual property
The NexusPool name, marks, site, and software are owned by SweetHash or its licensors and provided only for use in accordance with these Terms and any applicable open-source license. No rights are granted except as expressly stated.
13. Bitcoin network; third parties
SweetHash does not operate or control the Bitcoin network, mining hardware, hashpower marketplaces, or third-party services, and is not responsible for their behavior, availability, fees, rules, or changes (including difficulty adjustments, forks, or consensus changes).
14. Changes to these Terms
SweetHash may modify these Terms at any time by posting the updated version with a new "Last updated" date. Continued use after changes constitutes acceptance.
15. Availability; termination
NexusPool is provided at SweetHash’s discretion and may be changed, suspended, or discontinued at any time, with or without notice. You may stop using NexusPool at any time.
16. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Because NexusPool is offered as free software / a communication protocol and not as a product or service, it creates no commercial or consumer relationship and SweetHash imposes no mandatory arbitration or class-action terms; any residual dispute is governed by California law and, to the extent a court has jurisdiction, resolved in the state or federal courts located in California.
17. Severability
If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision is enforced to the maximum extent permitted.
18. Entire agreement
These Terms are the entire agreement between you and SweetHash regarding NexusPool and supersede prior understandings.
